Terms and Conditions of Use

Scope: these Terms and Conditions govern exclusively the use of the ariannadocs.it website as an informational/showcase site. They do not apply to the use of the ARIANNA software platform (SaaS service), access to and use of which by registered clients is governed by a separate Service Agreement/Terms of Service.

Use of the website ariannadocs.it (“Site”) is permitted within the limits set out in these Terms and Conditions of Use (“Terms”). Access to and browsing of the Site constitute full acceptance of these Terms. Anyone who does not fully accept these Terms is invited to refrain from using the Site.

1. Ownership of content

The Site, the information, texts, images, reproductions, logos (including the ELFO logo and the ARIANNA trademark) and any other material contained therein are the exclusive property of ELFO S.r.l. con socio unico (“ELFO”), with registered office at Via Pastore 3/5 – 29017 Fiorenzuola d’Arda (PC), Italy, VAT no. 00990320335, unless otherwise indicated.

2. License to use

ELFO authorises the viewing and downloading of materials available on the Site solely for personal, non-commercial use, in compliance with copyright law (Italian Law No. 633/1941 as amended) and the intellectual property rights relating to the materials, whether original or reproduced.

Without ELFO’s prior written authorisation, it is prohibited to:

modify, reproduce, distribute, or communicate to the public the Site’s materials;
use the materials for commercial purposes;
reuse the materials on other websites or computer networks;
remove copyright, trademark, or other ownership notices.

Unauthorised use constitutes a violation of applicable copyright, trademark, and intellectual property law, subject to the sanctions provided under Arts. 171, 171-bis, 171-ter, 174-bis and 174-ter of Law No. 633/1941.

Third-party trademarks that may be mentioned or reproduced on the Site belong to their respective owners and may be removed at the request of the rights holders.

3. Relationship with the Privacy and Cookie Policy

Use of the Site also involves the processing of personal data as described in the Privacy and Cookie Policy, which forms an integral part of these Terms.

4. Services and the ARIANNA platform

As stated above, these Terms do not govern access to or use of the ARIANNA software platform by registered clients. Such use is governed by a separate Service Agreement/Terms of Service, which typically includes: the object and scope of the service; access methods and credentials; the parties’ obligations; service levels (SLA) and availability; liability and limitations of liability; term, withdrawal, and suspension of the service; data processing as a processor under Art. 28 GDPR; and competent jurisdiction.

5. Changes

ELFO may modify these Terms and any other part of the Site at any time, without prior notice. Changes to published content may not be reflected on the Site immediately: it is the user’s responsibility to periodically check the most up-to-date version. Access to, browsing of, or use of the Site following the publication of changes constitutes acceptance of those changes.

6. Limitation of liability

To the maximum extent permitted by applicable law, ELFO and any third parties mentioned on the Site shall not be held liable for any damages of any kind (including, by way of example, damages arising from loss of profit, loss of data, or business interruption) arising from the use of, or inability to use, the Site, linked sites, or the materials and information contained therein, whether in contract, tort, or on any other legal basis, even where ELFO has been advised of the possibility of such damages. This limitation does not apply to damages caused by ELFO’s wilful misconduct or gross negligence, where such limitation is mandatorily excluded under applicable law.

Any costs of repair, maintenance, or correction of equipment or data arising from the use of the Site or the materials contained therein shall be borne by the user.

7. Governing law and jurisdiction

These Terms are governed by the laws of the Italian Republic. For any dispute concerning the interpretation, validity, or performance of these Terms, the Court of Piacenza shall have exclusive jurisdiction, without prejudice to the application of mandatory consumer protection rules where the user qualifies as a consumer.
